Town planning is a diverse discipline, that is, town planners represent and involve themselves at both a macro and micro level in the broad spectrum of planning. This could involve, at one end of the spectrum, the design of (say) new towns, suburbs , urban release areas and environments and/or urban renewal projects in an attempt to revitalise areas suffering from urban and infrastructure decay. At the other end of the spectrum town planners immerse themselves in representing individual or micro applications that support and uphold the broader principles of town planning.
When Council says you need a town planner what they are essentially saying is that you need a consultant that resides on the private sector “side of the fence” that is able to prepare the necessary documentation addressing and challenging the myriad of planning laws, guidelines and controls that dictate the direction of contemporary urban environments. Town planners are pivotal in coordinating and preparing detailed technical planning submissions that seek to maximise the use of any particular property to its best end; consistent with the objectives of any particular zone.
Not necessarily. At AconsulT we will identify the most efficient and cost effective approval pathway that has the best chance of attaining your development goals. In NSW the three primary pathways in obtaining the necessary approvals include:
1. Exempt Development - This is work that can be carried out without approval as long as it complies with stated controls;
2. Complying Development - This is development or work that can be approved utilising fast-tracked pathways through either a Private Certifier or a Local Council;
3. Development Application (DA) – Required for any development where Council is the consent authority. Whilst more involved the regulations, controls and guidelines are able to be challenged and variations sought, that is, a merit based assessment; subject to degree of variations and to what development controls;
Not to worry. Planning is not a “one size fits all” application. We will prepare detailed arguments that justify the variations sought, on your behalf. This is something we particularly welcome and pride ourselves on in seeking to obtain results that others cannot be bothered to attempt. Typically our approach is to “think outside the box”; whilst at the same time explaining to our client’s likely responses and outcome; we want the best development of your land which may not necessarily mean a development that is fully compliant.
Invariably this is like asking “how long is a piece of string” as time frames for approval rely heavily upon the type of development, the variations sought, Council’s timetable, the available approval pathways etc.
That said, if your development is consistent with Complying Development codes then your approval can be obtained as quickly as 10 – 20 days from the time the submission package is ready.
For Development Applications, councils have a statutory timeframe of 40 days (non integrated) to approve your application before legal avenues can be pursued.
